» pink101 - Bill of Attainder

In response to Reporter Arrested on Orders of Giuliani Press Secretary posted by Migisi:
.
The Patriot Act gives the president the Right issue a Bill of Attainder on any person.
.
That should shake the beegeesus out of every American.
.
If you don't know what a Bill of Attainder is, you had better check it out.
.
Some of the Founding Fathers were all for Bills of Attainder.

» Migisi - Bill of Attainder

In response to Bill of Attainder posted by pink101:
.
http://en.wikipedia.org/wiki/Bill_of_att...
"A bill of attainder (also known as an act or writ of attainder) is an act of legislature declaring a person or group of persons guilty of some crime, and punishing them, without benefit of a trial. The United States Constitution forbids both the federal and state governments to enact bills of attainder, in Article 1, Sections 9 and 10, respectively.
...
"Within the U.S. Constitution, the clauses forbidding attainder laws serve two purposes. First, they reinforced the separation of powers, by forbidding the legislature to perform judicial functions-since the outcome of any such acts of legislature would of necessity take the form of a bill of attainder. Second, they embody the concept of due process, which was later reinforced by the Fifth Amendment to the Constitution. The text of the Constitution, Article I, Section 9; Clause 3 is: No Bill of Attainder or ex post facto Law shall be passed.
.
"The constitutions of each and every State within the Union also expressly forbid bills of attainder. For example, Wisconsin's constitution Article I, Section 12 reads: No bill of attainder, ex post facto law, nor any law impairing the obligation of contracts, shall ever be passed, and no conviction shall work corruption of blood or forfeiture of estate.
.
Contrast this with the subtly more modern variation of the Texas version: Article 1 (Titled Bill of Rights) Section 16, entitled Bills of Attainder; Ex Post Facto or Retroactive Laws: Imparing Obligation of Contracts: No bill of attainder, ex post facto law, retroactive law, or any law impairing the obligation of contracts, shall be made.
.
"Up until 2002, only five acts of Congress had ever been overturned on bill of attainder grounds. The Elizabeth Morgan Act was overturned in 2003 as a bill of attainder. Many suggested that the Palm Sunday Compromise in the case of Terri Schiavo was also a bill of attainder."
.
==============================
.
The Patriot Act was passed in October, 2001 - a mere 45 days after 9-11. As I see it, it's definitely a bill of attainder, and it needs to be overturned pronto by the next President. Unfortunately, it was already reauthorized with some modifications in March 2006. Looks like few see it as a vehicle to deny every citizen their civil rights without cause and due process. But folks will feel its impact ... eventually. If they haven't already.
.
What I can't understand is the government's willingness to grant rights to illegal immigrants - while at the same time they willingly take away the rights of US citizens. Makes no sense.

.
Like I'm saying, the arguments over our civil rights have been reopened by the conservative movements in the United States.
.
They are applying rights intended for individuals to states and corporate structures including Rights of Empire.
.
Is this a stretch? I don't think so.
.
These ARE dangerous times for freedom.
.
One can forget one's Natural Rights if one even knows what they are.

.
Well, yes it does in a way. There are different kinds of rights.
.
Rights can be seen as property that one owns. This isn't to say that every one owns every right. I get it that you own some acreage there in Illinois. That means you have certain rights to do on your property whatever pleases you--that is a freedom to which you have rights. All human beings have certain rights that are seen as and called by the title of Human Rights--they are inalienable.
.
When it comes to illegal immigrants, we have to understand that they possess certain rights. Of course that doesn't mean they can use your acreage as they please. But, it does mean they have other rights that cannot be impeded.
.

.
While bills and writs of attainder are illegal in the United States, many people are issued a similar statement of guilt in the press.
.
And prosecuting attorneys often issue comments of guilt before their targets have had due process of law.
.
We are deep in a system of injustice where individuals (because of their politics or whatever else) are put in jeopardy of losing fair treatment in the halls of justice.
.
And, this is a serous problem for everyone.
.
At least I think so.
.
When an illegal American is treated with disregard to their Human Rights, my rights are jeopardized. And so are yours.
.
Give it some thought.
.
:~)

Sure it does. Granting rights to illegal aliens appeals to America's image of generosity and compassion--"Give me your tired, your poor . . . " We instantly associate this with the Statue of Liberty, Ellis Island, and America-The-Land-of-Opportunity.
.
Its the "sugar" politicians hope will persuade us to swallow the bitter pill of having our rights stripped away.

I watched that entire program live. Some of the call-ins brought strong dispute to Dr. Corsi's points. He defended himself pretty well. My big concern is for who will be our next president as Bush is pretty much turning into a lame duck. I sure hope it isn't Hillary as I suspect she is one of them.
.
The arguments and debates held over bills of rights in the founding days of America are confusing to say the least.
.
The Anti-Federalists can be seen as the true heroes of American justice in a certain sense. Their stated complaints against a federal, that is centralized, government that would have authority over individual states were that the federal government would be able to do that which George W Bush is attempting to pull off now. This makes me wonder if Bush and his counselors are not using some of the same arguments to push their powers of the executive branch of government today. Based on the "Supreme Law" clause, they might try to pull off some kind of an executive take over--in fact seem to be doing on a piecemeal basis.

"But while these three elements may factor into the decline of the revolutionary mindset, they are not the cause of this decline. The cause, quite simply, is the inability of people in the United States to attain, and maintain, the unity necessary to bring about meaningful change."
