As a joke, that's pretty funny. But, logically, I hope you can see there are several major problems with this. First, strict constructionism isn't just about original understanding - it's primarily about the TEXT. Second, originalism refers to legal understanding of principle - not the historical specific. For instance, according to the US Constitution, the President is the Commander in Chief of the army and navy. No mention of the air force. That's no problem with originalism.

To get this back on track....the point of the judicial branch is to play referee in our society. But referees are bound by the RULES - not by their opinions. Granted, referees are human and make mistakes. Some are biased. Some are smarter than others. Some are not altogether honest. That's the way it is in sports. It's the way it is in our court system. But, the STANDARD is that referees enforce the rules.

Well..that's what it's supposed to be with our courts. They are there to interpet and apply the rules. Who decides on those rules? The People - THROUGH their elected lawmakers.

Well sure they are, Brian. Control and interference with personal choice is what the anti-abortion movement is all about.

If it's a 'life issue' for you all... a sacred right to life... do you all oppose the death penalty and war? Innocent fetuses, infants, and children are killed in war.

It is preposterous to argue that the mainstream pro-life movement is motivated by a desire to control women. That's just ridiculous. For one thing, please don't presume to interpret the designs or intentions of my conscience or will or heart in this matter.

I am opposed to abortion on demand because I believe in protecting innocent life. I think it's highly disturbing (to put it mildly) that we've established a system whereby a person (man or woman) can unilaterally choose whether an innocent human being lives or dies.

The two of you don't have the right to presume to know what motivates my thinking or WHY I'm pro-life. I have a right to speak for myself in that regard. I certainly wouldn't presume to tell YOU why YOU are pro-choice.

I want an answer to my previous post on your presumptuousness, but I'll answer this in the meantime.

Your argument here is fallacious. Is someone who supports war in certain circumstances or capital punishment in certain circumstances not qualified to speak out against murder?

The Judeo-Christian tradition has long recognized the validity of war as defense. I'm sure you're familiar with Augustine's just war theory. This is NOT inconsistent with the pro-life position that a woman has the right to abort her child if her (the mother's) life is in danger. The right of self-defense has been consistently applied here.

As for capital punishment, I will concede your point if and when...

1) We provide defense counsel (taxpayer funded if the pre-born baby can't hire an attorney on her own) to advocate on behalf of the pre-born baby

2) There is a trial by jury to determine if the pre-born child warrants legal protection

3) There is an appeals process in place if the child loses the first round

4) Oh, and if the pre-born baby is found guilty of an offense that would warrant her execution

Put those things in place, and we'll talk.
